Collective bargaining may therefore be defined as a method of resolving conflicts which is characterized by involvement of at least two opposed parties who have a different or even opposed interest in the outcomes of decisions, but who come together voluntarily to decide matters of concern. Collective Bargaining agreement is an agreement made between a trade union and an employer or organization of employers which relates to terms and conditions of employment whether or not enforceable in law and whether or not concluded under machinery for negotiation, arbitration or adjudication. Integrative bargaining This is bargaining that creates co-operative negotiation relationship that benefits both employees and employers. It has the following

In the event of failure by the union and management in an industry or firm to reach a settlement, either party may refer the dispute to the minister for labour in accordance with the trade disputes act.

The Minister may then take any of the following options:-

• Refer the dispute for renegotiation or arbitration for the voluntary settlement of the dispute.
• Refer the dispute to industrial court.
• Declare the actual or threatened strike/industrial action unlawful.

When a dispute is referred to the Industrial Court, the Judge will make a final decision after giving each party a hearing.
